AERFUN BALLOONS Terms and Conditions
The passengers state to have read and to accept the general conditions of sale described hereafter:
Ticket purchase: This contract is made between you and AERFUN Balloons but you can give it to someone else. These Terms & Conditions will still apply to « you » or the beneficiary. If you purchase a ticket through an agent or a hotel you agree to these terms with us and not with the agent or the hotel. If you do not agree to be bound by these terms and conditions you should contact us immediately.
Our obligations to you: The voucher will entitle you to participate in a hot air balloon flight experience at a date to be arranged during booking process.
Prices: all ticket prices are quoted per person, included VAT and insurance and can be modified at any time without notice.
Payment: if payment was not made in full when the ticket was purchased, the balance must be made not later than 7 days before the date for which you have booked your flight.
Validity of transport ticket: unless otherwise specified, our tickets are valid for 24 months since their date of emission. At the end of this period, the ticket will automatically expire. In addition, the ticket will expire in the event of no confirmation of the flight by the Customer or of no presentation at the place where an appointment has been agreed.
Medical conditions: We are not qualified to confirm your fitness to fly. You must ensure that you do not have any pre-existing medical conditions which could affect the ballooning experience or could prevent you from safely taking part. You must not fly if you are suffering from any significant medical condition or if you have recently undergone major surgery. You must not fly if you are pregnant or under the influence of drink or drugs. We require you to tell us about any medical or physical condition that could be considered to affect your safety or the safety of others. In doubt, please check your medical ability with your doctor using the following questionnaire
Children : we will not accept children under the age of 6 years. A child under the age of 12 years must be accompanied by a responsible adult.
Clothing: we recommend you to wear casual clothing (natural fibre or cotton clothing preferably). Flat shoes and trousers are recommended for the ladies (no high heels). We recommend wearing a cap or headgear for tall people
Flight confirmation: In order to confirm your flight, you must telephone the contact number provided in the confirmation mail between 24 hours and 12 hours prior the scheduled take-off time to confirm weather conditions are suitable for flying and to reconfirm the meeting point and time. We ask you to be reachable by phone at any time during the 24 hours preceeding the flight
Flight conditions: Hot air balloon flights are entirely dependent on weather conditions, so we cannot guarantee the flight will certainly take place exactly at the appointed time, place, direction, etc. Any flight may be cancelled by the pilot at any time before the flight or during the flight. Minimum weather conditions required for a balloon flight are:
– No rain or fog
– Visibility more than 2 km;
– Clouds higher than 1500 feet;
– Wind speed on the surface less than 16 km/h
– No stormy or pre-stormy conditions
The flights are proceed under VFR (visual flight rules), as defined in the regulations of the Directorate General of Civil Aviation). Average flight duration is 1 hour.
Flight cancellation policy: AERFUN Balloons reserves the right to defer a flight in the following cases: bad weather conditions, unsufficient number of passengers or unsatisfactory conditions of safety. If one or more of these conditions occur, a new date will be fixed by mutual agreement between the parts. If you don’t have other dates available for the flight, your flight will be refunded (weather cancellation insurance). In no case, AERFUN Balloons could be held responsible for the expenditure engaged by the passengers to go on the place of appointment or returning trip. In the event that AERFUN Balloons and/or partners are required to travel to a remote site (group flights), the expenses engaged for the transport of the balloons and crew as well as for the food (buffet champetre) will in no case be reimbursed.
Cancellation insurance: included in all of balloon flight services, cancellation insurance ensures a full ticket refund in the case of cancellation because of unsuitable flying or safety conditions (Only AERFUN Balloon and partners are entitled to state about the flying and safety conditions).
In the case of a cancellation from your side, you will get refund less the cost of this insurance (30 € per ticket). No justification will be asked. Important: if you cancel your reservation within 72 hours preceding the boarding time or if you are not present at the scheduled time, you will not be entitled to a rescheduled flight or a refund. The ticket will become invalid
Note: this insurance do not cover any other personal cancellation risks or damages.
Note: payments are made in euro (€). For payments operated in another currency, a slight difference can be checked between initial payment and refund payment because of a fluctuation of exchange rate.
Transport: The Customer is fully responsible for organizing his transport to the meeting point and for return trip. On Customer request, AERFUN Balloons can put the Customer in relation with a local transport company. The contract will be established between the transport company and the Customer. Payment will have to be done directly to the transport company. Under no circumstances will AERFUN Balloons be responsible for any damage, death or injury caused by the transport company.
No show policy: We ask you to be present at the meeting point at the exact scheduled time set by the coordinator during flight confirmation, Any delay or no-show at the meeting point at the time will result in the automatic cancellation of your ticket and reservation. You will not be entitled to any rescheduled flight or refund, no matter what the reason.
Boarding policy: Customers must be in possession of a valid ticket or a flight reservation number issued by AERFUN Balloons in order to board our balloons. Our pilots have final responsibility of a flight and have complete discretion as to whether to allow you to board the balloon basket. You will be refused boarding if in the pilot’s opinion you would be a risk to the balloon or to the passengers or to yourself.
Flight policy: As balloon flights are wind dependent, we cannot guarantee a flight will follow any particular direction. It is our intention that the balloon will be in the air for approximately 1 hour but the pilot has ultimate responsibility for deciding the duration and conduct of any flight and the appropriate time and place of any landing. Flights are undertaken within the limitations of VFR (Visual Flight Rules, as defined by the regulations of the French Civil Aviation Authority (DGAC)
On-board policy: During the flight, the pilot is the sole master on board. He may decide at any time to stop the flight if the safety of the flight is compromised. Passengers must comply with the instructions given by the pilot, especially during the take-off and landing phases. The pilot also reserves the right to disembark any passenger whose behavior would be dangerous to the safe running of the flight, without the latter being able to claim any compensation whatsoever.
Flight duration: For safety reasons, regulation of air traffic, weather and any other restrictions, the pilot reserves the right to change the duration of flight, the launch site, the time of appointment. No benefit will be refunded if the flight lasted a minimum of 40 minutes. If the duration of the flight is less than 40 minutes, the Customer will be able to claim compensation corresponding to the proportion of the flight time not performed.
Sub-contractors: AERFUN Balloons reserve the right to sub-contract flights to companies under contract with AERFUN Balloons Company. All our partner companies are licensed by the French Civil Aviation Authority. On request, we can provide partner information and insurance certificate covering death, personal injury and damage.
Insurance : civil liability insurance is included in the price ticket for each passenger. The level of insurance is in accordance with international agreements covering air transportation required by the Warsaw Convention. We will not be liable for any loss or damage to equipment and personal effects including clothing, cameras and jewels brought with you on the flight. If you do not consider the amount of insurance cover would be adequate to compensate you for any loss whether for death, personal injury or damage to your belongings you should take out your own additional cover.
Governing law: terms & Conditions of our services shall be governed by French laws. To the extent limited by Law, any disputes arising from the execution of our services shall be governed by French laws and the Courts of France shall have exclusive jurisdiction.
